The declaration of entry by a transport vehicle here generally refers to the declaration by cargo-carrying transport vehicles such as ships, airplanes, and trains to customs, indicating their arrival at our port.
If the consignee fails to declare within the 14-day period, customs will levy a late declaration fee on a daily basis. The formula for calculating the late declaration fee is: Late Declaration Fee Amount = Taxable Price of Imported Goods × 0.5‰ × Period of Late Declaration. For example, if Mr. Xiong imports a batch of goods with a taxable price of 1 million yuan, and the delay is 5 days, the late declaration fee amount = 1,000,000 × 0.5‰ × 5 = 2500 yuan. This undoubtedly increases the import cost.
Declaration Deadlines in Special Circumstances
For goods imported or exported via cables, pipelines, or other special methods, the declaration deadline differs from that of conventional transport vehicles due to the special nature of their transportation. The operating unit shall regularly declare to the designated customs and handle relevant procedures.
Another situation is for imported goods under transit. If it is an advance declaration method, the consignee or their agent shall enter the electronic data of the import declaration form to the customs at the destination before handling the transit procedures at the customs of entry. The customs at the destination will accept the electronic declaration in advance, and within 5 days from the date of acceptance, the consignee or their agent shall handle the transit transportation procedures at the customs of entry. If it is a direct transit method, the consignee or their agent shall enter the transit declaration data to the customs of entry and handle the transit transportation procedures within 14 days from the date of the transport vehicle's declaration of entry.
Handling of Overdue Undeclared Goods
If imported goods are not declared to customs within 3 months from the date of the transport vehicle's declaration of entry, the imported goods shall be seized and sold by customs according to law. The proceeds from the sale, after the priority payment of actual expenses incurred in the sale and disposal, shall be deducted in the order of transportation, loading, unloading, storage, and other expenses; import duties; customs duties and taxes levied at the import stage; and late declaration fees.
The remaining funds, if applied for by the consignee within 1 year from the date of the lawful sale of the goods, shall be refunded; however, those subject to national restrictions on imports, for which the required permits and certificates cannot be provided, shall not be refunded. If no application is made within the time limit or if it is not to be refunded, the funds shall be turned over to the state treasury.
