If an export agent receives payment but withholds it, first, you can engage in friendly communication with the export agent based on the agency agreement, clearly pointing out that their actions violate the agreement and demanding timely payment as stipulated, while keeping records of all communications. If communication is unsuccessful, you can file a complaint with an industry association, such as the China Chamber of International Commerce, which can mediate and facilitate a solution. If it remains unresolved, you can also consider legal action by filing a lawsuit with the court. Using the agency agreement and evidence that the payment has reached the agent's account, you can demand the return of funds and compensation for breach of contract. Concurrently, you can apply for asset preservation to prevent the agent from transferring assets. In summary, take timely measures to protect your legitimate rights and interests.

You can check the agency agreement for dispute resolution clauses. For example, if an arbitration institution is specified, you can apply for arbitration with that institution. Arbitration might be a simpler and quicker process compared to litigation.
